Terms of Service

These Terms of Service (the "Terms") govern your access to and use of ALIGN, a cloud platform to build, host and share web maps and GIS applications (the "Service"), operated by GEO NOVA SRL, a company registered in Belgium (enterprise number 1017.888.306) with its registered office at Rue de la Consolation 62/3, 1030 Schaerbeek, Brussels, Belgium ("ALIGN", "we", "us").

By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you confirm that you are authorized to bind that organization, and "you" refers to that organization. If you do not agree, do not use the Service.

1. The Service

ALIGN lets you create web maps and GIS web applications, store geospatial data, use AI assistance, connect third-party services, and publish and host the result. The Service is provided on an ongoing basis and may currently be offered as a test or early-access version, which means features may change, be added, or be removed.

2. Accounts and eligibility

• You must be at least 16 years old, or the age of digital consent in your country, to use the Service.
• You are responsible for the accuracy of your account information and for keeping your credentials secure.
• You are responsible for all activity that occurs under your account.
• Notify us promptly at contact@geonova.be if you suspect unauthorized use.

3. Acceptable use

You agree not to:

• use the Service to violate any law or the rights of others;
• upload or process data you do not have the right to use;
• attempt to breach, probe or disrupt the security or integrity of the Service;
• reverse engineer, resell or provide the Service to third parties except as expressly permitted;
• use the Service to build or distribute unlawful, harmful or infringing content;
• place an unreasonable load on the infrastructure or circumvent usage limits.

4. Your content and data

You retain all ownership of the data, geospatial layers, code and applications you create or upload ("Your Content"). ALIGN claims no ownership over Your Content. Your Content stays yours, in open formats, and you can export it and take it with you.

You grant us a limited license to host, store, copy, process and transmit Your Content solely to operate, secure and improve the Service for you, and to the extent necessary to provide the features you use (for example running your live preview, saving a web map, or executing a data operation you request). This license ends when you delete Your Content or close your account, subject to routine backups and legal retention.

You are responsible for maintaining your own copies of Your Content.

5. AI features

The Service includes AI assistance. When you use it, your prompts and the relevant context are sent to third-party model providers that process them on our behalf, or, where you enable your own provider keys ("bring your own key"), to the provider you selected. AI output can be inaccurate or incomplete. You are responsible for reviewing AI output before relying on it, and everything the AI does, you can also review and change yourself.

6. Third-party services

The Service can connect to third-party services (for example a database provider, a mapping library, or an authentication provider). Your use of those services is governed by their own terms, and we are not responsible for them. Any credentials you connect are used only to provide the feature you enabled.

7. Intellectual property

The Service itself, including its software, design, templates, widgets and brand, is owned by ALIGN or its licensors and is protected by intellectual property laws. These Terms grant you no right in the Service other than the limited right to use it. Applications and code you build with the Service belong to you, as described in section 4.

8. Fees and payment

• The Service is offered through subscription plans that include a set amount of AI (LLM) credits. When your included credits are used up, you can add more credit (top-up). Credits are debited as you use AI and platform actions.
• Prices, credit and usage rates are shown in the Service and may change with reasonable notice.
• Consumed usage is non-refundable except where required by law.
• Fees are stated exclusive of taxes; you are responsible for applicable taxes.
• Payments, top-ups and any subscription plans, where offered, are processed by Stripe.

9. Changes to the Service

We may modify, update or discontinue features of the Service. We will try to give reasonable notice of material changes that adversely affect you. Because the Service may be offered as a test version, availability and features are not guaranteed.

10. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends; sections that by their nature should survive (ownership, disclaimers, liability, governing law) will survive.

11. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure.

12. Limitation of liability

To the maximum extent permitted by law, ALIGN will not be liable for any indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

You agree to indemnify and hold ALIGN harmless from claims, damages and costs arising out of Your Content or your use of the Service in breach of these Terms or applicable law.

14. Confidentiality

Each party will protect the other's non-public information with reasonable care and use it only to perform under these Terms, except where disclosure is required by law.

15. Governing law and disputes

These Terms are governed by the laws of Belgium, without regard to conflict of law rules. The courts of Brussels, Belgium have jurisdiction, subject to any mandatory consumer protections available to you.

16. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the date above and, where appropriate, notify you. Continued use of the Service after changes take effect means you accept the updated Terms.
